Direct Orders from Customers
The order placed can only be filled if the items ordered are available. Should a title not yet have been published, the order will be prebooked. The items supplied will remain the property of Mohr Siebeck until the purchase price has been paid in full. Delivery will be charged to the customer. The shipping costs will be calculated according to the weight of the shipment. Invoices for items ordered are payable immediately. The amounts due are to be transferred without any deduction to one of the Mohr Siebeck bank accounts listed on the invoice.
Return and Cancellation
The customer may cancel the order by mail, fax or e-mail within two weeks after it has been placed without stating the reasons for this. The termination period shall commence upon receipt of this notification in writing, however not before receipt of the goods by the customer (however, in the event of a recurring delivery of similar goods, not before receipt of the first instalment thereof) and not prior to us fulfilling our information obligation pursuant to section 312c subsection 2 of the German Civil Code in conjunction with section 1 subsection 1,2 and 4 of the Information Regulation in the German Civil Code in conjunction with section 3 of the same regulation. Notice of cancellation must be given by the customer within this period of time to the above mentioned address of Mohr Siebeck. In the case of electronic products, the buyer may not cancel the order or return the items after the seal of the CD-ROM has been broken.
Consequences of Cancellation
Should the cancellation take effect, the receivables resulting from the delivery of goods and services for both parties are to be refunded and if necessary any interest earned by Mohr Siebeck is to be refunded. If the customer cannot return the items received completely or partially, or if these items have deteriorated in quality after receipt by the customer, the customer will compensate for the extent of the lost value. This does not apply to the surrender of goods if the deterioration of the product can be attributed solely to the inspection thereof in a manner similar to inspecting a product personally in a store. The customer can avoid the obligation to compensate for lost value for the deterioration due to the use of the product as specified by not using the product as his/her own property and refraining from doing anything which could detract from its value. The goods are to be returned at the customer's expense if the goods delivered correspond to the goods ordered, if the price of the product to be returned does not exceed €40 or, should the price exceed this amount and neither partial nor full payment of the goods has been made. In all other cases, the return consignment is free of charge for the customer. Obligations to refund payments must be fulfilled within 30 days. The time specified for the customer shall commence when the product has been shipped, and for Mohr Siebeck upon receipt of the product.
Place of Execution and Jurisdiction
The place of execution of the contract is Tübingen. The place of jurisdiction for all transactions with merchants, legal entities of public law and separate funds under public law is Tübingen.
