Hugo Sinzeimer is considered to be one of the fathers of German collective labor law, and in fact the basic dogmatic structures of the current law concerning collective bargaining are based substantially on Sinzheimer’s work. Although it has become a matter of course for labor law dogmatics today to use the range of legal measures created by Sinzheimer, there is a great deal of disagreement in regard to the assessment of his basic theoretical and methodical assumptions on which his writings on labor law are based. Sandro Blanke closes this gap by analyzing Sinzheimer’s work on labor law in the context of his other writings on legal policy, legal philosophy and the sociology of law. He shows that Sinzheimer’s basic theoretical assumptions differed clearly from those of the other advocates of the labor law jurisprudence which was becoming established in Weimar at that time.
