The challenges faced by copyright law as a result of digitization are enormous, and there is a need in particular to reassess exceptions and limitations on copyright. An example of the applicability of copyright limitations to digital uses is the discussion as to whether or not electronic press reviews can be compiled and disseminated without the prior consent of the holder of the rights on the basis of section 49 of the Copyright Act. Even the judicial decision made by the German Federal Supreme Court in 2002, which was affirmative subject to certain conditions, has not helped to clarify this issue conclusively. Based on this judicial decision, Vera Glas studies the compatibility of the current legal position with the standards in the directive on the harmonisation of certain aspects of copyright and related rights in the information society. After having dealt with the legal position in selected EU member states, she then describes the results for national law.
