An Historical-Comparative Study of German, French and English Law from Ius Commune until Today.]Published in German. Stephan Balthasar analyzes the protection of privacy in England, France and Germany. To begin with, he focuses on the historical development, in particular on the continental ius commune, where the actio iniuriarum offered a certain protection of secrecy and privacy. In the second part of his work, he describes the modern law of privacy, taking into account the recent development in England after the Human Rights Act took effect in 1998 and considering recent decisions such as Campell v. MGN ([2004] UKHL 22) and the landmark ruling of the European Court of Human Rights in the case of Princess Caroline (von Hannover v. Germany). Whereas the historical differences between the three countries seem rather substantial, nowadays the three legal systems adopt very similar solutions to the problem of protecting privacy.
