The exclusion of evidence has been a controversial subject for a long time, but this has always applied to special types of procedures only. In this work, Olaf Muthorst attempts to outline a general theory of the exclusion of evidence which can be used for all judicial and official proceedings. He bases this theory of the exclusion of evidence on the idea that evidence is subject to the law, as are the entire proceedings. Ascertaining individual cases in which evidence is excluded is a question of shaping and applying subconstitutional law. Thus it is possible to find criteria for determining when the evidence is unnecessary or inadmissible.
